No. 10228 of 2026 ORDER : The Court made the following order :- The petitioner/sole accused, who apprehend arrest at the hands of the respondent for the offences punishable under Sections 296(b),316(2), 318(4), 351(2) of BNS in Crime No.420 of 2025 on the file of the respondent police, seeks anticipatory bail. 2. The case of the prosecution is that the parents of the defacto complainant deposited a sum of Rs.17,00,000/- as fixed deposit in the company namely Sornalatha Investment, Dindigul and after maturity the accused persons refused to repay the said amount. Hence the case. 3. The learned counsel for the petitioner would submit that the petitioner is innocent and a false case has been foisted against him. The petitioner has nothing to do with the alleged crime. He would further submit that part amount has been paid and they are ready to pay the balance amount within six months. Hence, he prays to grant anticipatory bail to the petitioner. 4. The learned Government Advocate (Crl.Side) would submit that accused persons received money from the defacto complainant and 2/6 https://www.mhc.tn.gov.in/judis CRL OP(MD). No. 10228 of 2026 thereafter refused to repay the amount with interest, hence he strongly opposed to grant anticipatory bail to the petitioner. 5. Heard both sides and perused the materials available on record. 6. Considering the rival submissions on either side, considering the nature of offences and also considering the fact there is a dispute between the parties and the matter has been referred to mediation centre and through mediation part amount has been paid by the petitioner to the defacto complainant and now the petitioner also assured to pay the money within six months and also considering the fact that the alleged occurrence took place in the year 2021 but the First Information Report has been registered only on 13.11.2025 and also considering all other factors, this Court is inclined to grant anticipatory bail to the petitioner, subject to the following conditions: [a] Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, within a period of fifteen days from the date on which the order copy made ready, before the Judicial Magistrate Court No.I, Dindigul on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- 3/6 https://www.mhc.tn.gov.in/judis CRL OP(MD). No. 10228 of 2026 (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further conditions that: [b] the petitioner shall report before the respondent police daily at 10.30 a.m.,until further orders [c] the petitioner shall not commit any offences of similar nature. [d] the petitioner shall not abscond either during investigation or trial. [e] the petitioner shall not tamper with evidence or witness either during investigation or trial. [f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. 4/6 https://www.mhc.tn.gov.in/judis CRL OP(MD).
