Rahul Sarkar Mr. Shibaji Kumar Das Ms. Deblina De …for the petitioner This application under Article 227 of the Constitution of India is at the instance of the wife praying for a direction upon the learned Additional District Judge, Fast Track 4th Court at Barrackpore to dispose of the Misc. Case No. 3 of 2024 arising out of the Matrimonial Suit No. 1775 of 2023 expeditiously. Learned advocate appearing for the petitioner submits that after the matrimonial suit was decreed ex parte, the petitioner filed the instant Misc. Case under the provision of Order 9 Rule 13 of the Civil Procedure Code. She further submits that the summons in respect of the misc. case has been duly served upon the opposite-party and the opposite- party has already entered appearance in the said misc. case. She further submits that the evidence of the wife has already been concluded in the meantime and December 3, 2026 is fixed for evidence of the husband/opposite-party. 2 In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with a server copy of this order, upon the opposite party or upon the learned advocate representing the opposite party before the learned trial judge forthwith. In the light of the submission made by the learned advocate appearing for the petitioner, this civil revisional application stands disposed of by requesting the learned Additional District Judge, Fast Track 4th Court at Barrackpore to dispose of the Misc. Case No. 3 of 2024 as expeditiously as possible, preferably within a period of four months from the next date fixed, without granting any unnecessary adjournment to either of the parties.
