ORAL ORDER
1. Accused in Special Case No.3/2026 pending before the Court of Additional City Civil and Sessions Judge, FTSC-IV, Bengaluru, arising out of Crime No.352/2025 registered by Yelahanka Police Station, Bengaluru, for the offences punishable under Sections 87, 351(2), 65(1) and 64(2)(m) of BNS, 2023, Sections 4(2), 5(l) and 6 of the POCSO Act, 2012 and Section 9 of the Child Marriage Restraint Act, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the petitioner and the learned HCGP for respondent No.1. Respondent No.2, who is served in the matter has remained unrepresented before this Court. - 3 -

FIR in Crime No.352/2025 was registered by Yelahanka Police Station, Bengaluru, for the aforesaid offences against the petitioner based on the first information dated 07.10.2025 received from respondent No.2, who is the mother of the victim girl. In the said case, petitioner was arrested on 29.10.2025 and remanded to judicial custody. After completing investigation, charge sheet has been filed against him for the aforesaid offences. His bail application filed before the Trial Court was rejected and therefore, he is before this Court. 4. In the first information dated 07.10.2025 submitted by the mother of the victim, she has stated that her minor daughter aged 16 years was missing for the last one week and on 03.10.2025, she had called her over her mobile phone and informed that she is in love with the petitioner and she had married him. He had taken her to his house at Allasandra and had forcible sexual intercourse with her. It is under these circumstances, FIR was registered against the petitioner for the aforesaid offences. During the course of investigation, petitioner and the victim girl were traced in his house at

Allasandra in Bengaluru. Petitioner, who was arrested on 29.10.2025, was thereafter remanded to judicial custody. 5. Statement of the victim girl under Section 183 of BNSS, 2023, was recorded by the jurisdictional Magistrate. In the said statement, the victim girl has clearly stated that she was in love with the petitioner and she had voluntarily left her house and gone with the petitioner and subsequently, they got married.
She has stated that after marriage, she stayed in his house at Allasandra and once they had consensual sex. Material on record would go to show that victim and her mother have not cooperated for the medical examination of the victim in the present case. Petitioner aged 20 years having no other criminal antecedents is in custody from 29.10.2025. Investigation of the case is now completed and charge sheet has been filed. Considering the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following order:-

6. The petition is allowed. The petitioner is directed to be enlarged on bail in Special Case No.3/2026 pending before the Court of Additional City Civil and Sessions Judge, FTSC-IV, Bengaluru, arising out of Crime No.352/2025 registered by Yelahanka Police Station, Bengaluru, for the offences punishable under Sections 87, 351(2), 65(1) and 64(2)(m) of BNS, 2023, Sections 4(2), 5(l) and 6 of the POCSO Act, 2012 and Section 9 of the Child Marriage Restraint Act, subject to the following conditions:
a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;

e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off.
