Accused no.1 in Crime No.72/2026 registered by Kalasipalya Police Station, Bengaluru City, for the offences punishable under Sections 318(4) read with 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.72/2026 was registered by Kalasipalya Police Station, Bengaluru City, for the aforesaid offences against the petitioner and another based on the first information dated 31.03.2026 received from Amarin Taj who is the alleged victim in the present case. During the course of investigation, petitioner was arrested on 11.05.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.5344/2026 was rejected on 09.06.2026. Therefore, he is before this Court. 4. In the first information dated 31.03.2026 submitted by the alleged victim, she has stated that for the last about two - 3 - HC-KAR CNR: KAHC010467272026 NC: 2026:KHC:42576 CRL.P No. 10064 of 2026 years she has been pledging jewellery in the jewellery shop of accused nos.1 & 2 and receiving the money from them. In the month of January 2026, she had paid a sum of Rs.1,60,000/- to the accused persons along with original slip under which she had pledged the gold jewellery weighing 43.950 grams and had asked them to return the said jewellery which was pledged on 20.05.2024. The accused persons who had received the amount of Rs.1,60,000/- had assured to hand over the gold jewellery on the next date. But thereafter, they had not handed over the gold jewellery and it was subsequently found that their jewellery shop was closed. It is under these circumstances, the first informant had approached the police on 31.03.2026. 5. Accused no.2 has been granted anticipatory bail by the coordinate bench of this Court in Crl.P.No.6637/2026 disposed on 21.05.2026. Petitioner, who has no other criminal antecedents is in custody in the present case for the last more than three months. Investigation of the case is completed and charge sheet is filed. The maximum punishment for the alleged offences is imprisonment for a period of seven years. Under the circumstances, I am of the opinion that petitioner's prayer for - 4 - HC-KAR CNR: KAHC010467272026 NC: 2026:KHC:42576 CRL.P No. 10064 of 2026 grant of regular bail is required to be answered affirmatively. Accordingly, the following order: 6. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.72/2026 registered by Kalasipalya Police Station, Bengaluru City, for the offences punishable under Sections 318(4) read with 3(5) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of - 5 - HC-KAR CNR: KAHC010467272026 NC: 2026:KHC:42576 CRL.P No. 10064 of 2026 the said Court until the case registered against him is disposed off.
