1. The prayer made in the present petition is for commanding the respondent No. 1 to 4 to immediately prepare the pension case and submit the same to the Accountant General Office, with further prayer for commanding the respondent No. 5 to settle the case on priority. 2. The contesting respondent No. 2 to 4 have responded to the petition by stating that during service, the petitioner was sanctioned an amount of approximately Rs. 1.23 crore from the Accounts Section for official purposes. Upon scrutiny of records, it was found that an amount of Rs. 72,18,360/- has remained unadjusted and outstanding against the petitioner. In order to

settle the controversy, the Committee was constituted vide order dated 25.01.2024, comprising senior officers, to verify cash books, bank statements, vouchers and bills. The Committee, after due verification, categorically found Rs. 72.18 lacs outstanding and recommended reflection of the outstanding amount in the pension case and recovery of the same from pensionary benefits of the petitioner. It is further stated that since the petitioner failed to clear his outstanding amount, respondents lawfully processed his provisional pension case by reflecting all outstanding amount and forwarded the same to the office of Accountant General vide order dated 27.01.2026. 3. Learned counsel for the petitioner submits that the report of the committee dated 25.01.2026 was submitted at the back of the petitioner and the petitioner was not associated before finalizing the said report. He further submits that while making recommendation the committee has not taken note of certain vouchers which were lying with the petitioner. He further submits that the said committee shall consider those vouchers and pass fresh orders in accordance with law. 4. Mr. Waseem Gull, learned GA submits that if the petitioner has some vouchers, he can submit those vouchers before the Committee and the same shall be considered in accordance with law. In view of the above, the present petition is disposed of by directing the petitioner to submit all vouchers lying with him to respondent No. 3 within a period of 15 days from today and thereafter the respondent No. 3 shall submit those vouchers to the Committee and the Committee shall consider the same and thereafter shall pass fresh orders in accordance with law within a period of three months. In case of any discrepancy in the vouchers, the petitioner shall render all assistance to the committee to clear that discrepancy. 6. Disposed of as above. (Rajnesh Oswal)
