Accused in Special Case No.158 of 2025 pending before the Court of I Additional District and Session Judge, Ramanagara, arising out of Crime No.55 of 2025 registered by Ramanagara Women Police Station, Bengaluru South, for offences punishable under Sections 4 and 6 of POCSO Act, 2012 and Sections 65(1) and 137(2) of BNS, 2023 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the petitioner and learned HCGP on behalf of respondent no.1 - State. Respondent no.2 who is served in the matter has remained unrepresented before this Court. 3. A FIR in Crime No.55 of 2025 was registered initially for offence punishable under Section 137(2) of BNS, - 3 - HC-KAR CNR: KAHC010023352026 NC: 2026:KHC:40308 CRL.P No. 500 of 2026 2023 against unknown person, based on the first information dated 19.04.2025 received from respondent no.2, who is the mother of the victim girl. Perusal of the first information would go to show that, victim girl was found missing from her house on 14.04.2025 and it is under the circumstances, her mother had approached the police on 19.04.2025. During the course of investigation, petitioner and the victim girl were traced together. 4. Statement of the victim girl has been recorded in the present case under Section 183 of BNSS, 2023, before the jurisdictional Magistrate wherein she has stated that, she is in love with the petitioner and she had voluntarily accompanied him to a temple and thereafter, had gone to his sister's house and stayed there. She has not made any allegation against the petitioner about he committing any kind of sexual assault on her, much less, penetrative sexual assault. The victim girl and her mother have not cooperated for the purpose of medical examination of the victim girl. The petitioner aged 20 years is in custody for the last one year. The petitioner is directed to be enlarged on bail in Special Case No.158 of 2025 pending before the Court of I Additional District and Session Judge, Ramanagara, arising out of Crime No.55 of 2025 registered by Ramanagara Women Police Station, Bengaluru South, for offences punishable under Sections 4 and 6 of POCSO Act, 2012 and Sections 65(1) and 137(2) of BNS, 2023, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. - 5 - HC-KAR CNR: KAHC010023352026 NC: 2026:KHC:40308 CRL.P No. 500 of 2026 e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
