This is the first bail application filed under Section 483 of Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant, who has been arrested in connection with Crime No.02/2026, registered at Police Station Cyber Cell, District Raigarh (C.G.) for the offence punishable under Sections 318 (4), 308 (6), 112 (2) of BNS and Section 66 (d) of IT Act. The case of the prosecution, in brief, is that the complainant Narendra Singh Thakur, lodged an FIR alleging that he received a phone call from an unknown person who claimed to connect him with the TRAI Department. Thereafter, he was falsely informed that another Jio mobile number issued in his name was being used for illegal activities. By impersonating officials of the TRAI, police, and other investigating agencies, the fraudsters allegedly induced the complainant to transfer a total amount of Rs. 36,97,117/- through multiple UPI transactions on different dates under the pretext of verification and investigation. On the basis of the said complaint, the police registered the FIR and commenced investigation into the alleged offences of cyber fraud. Hence, the bail application. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in crime in question. He further submitted that the applicant has been arrested only on the basis of the memorandum statement of other co-accused persons. The co-accused Aarti Rajput has already been granted regular bail by this Court vide order dated 10.07.2026 in MCRC No.4894/2026, the applicant is in jail since 22.04.2026, he has no criminal antecedent, charge sheet has been filed and trial is likely to take quite long time for its conclusion, therefore, he prays that the applicant be released on regular bail. 3 4. On the other hand, learned State counsel opposes the bail application of the applicant and submits that He further submits that the applicant allegedly was a member of the group involved in the alleged cyber fraud and, during the course of investigation, his role surfaced in relation to the receipt and distribution of the cheated amount. It is alleged that he shared a portion of the proceeds of the crime and thereby participated in the commission of the alleged offences. It is further submitted that the bail application of the co-accused Raviraj Singh has already been rejected by this Court vide order dated 10.07.2026 and the co- accused Aarti Rajput has been granted regular bail only on the ground that she was a lady and had one minor child. Therefore, the applicant is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused all the documents available on record. 6. Considering the facts and circumstances of the case, the nature and gravity of the offence, the material available in the case diary, and the fact that the investigation prima facie reveals the involvement of the applicant in a well-organized cyber fraud involving digital arrest, impersonation of public officials, and cheating the complainant of an amount of Rs. 36,97,117/-, coupled with the memorandum statements, recovery of electronic devices, and the allegation that the applicant shared in the proceeds of the crime, as such, without expressing any opinion 4 on the merits of the case, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the instant bail application of the applicant Sanjay Meena, involved in Crime No.02/2026, registered at Police Station Cyber Cell, District Raigarh (C.G.) for the offence punishable under Sections 318 (4), 308 (6), 112 (2) of BNS and Section 66 (d) of IT Act, is rejected.
