05.08.2026 Court No.35. D/L.560. Rakib (Rejected)
CRM (A) 1673 of 2026
In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Domjur Police Station case no. 162 of 2026 dated 20.03.2026 under Sections 103(1)/3(5) of the Bharatiya Nyaya Sanhita, 2023.
And In the matter of : Tara Naskar @ Tara Rani Naskar
……Petitioner. Mr. Moyukh Mukherjee Mr. Ashok Das Mr. Sourav Mukherjee Mrs. A. Dey
.....for the Petitioner. Mr. Avik Ghatak Mr. Sagnik Mukherjee Mr. S. Kar
......for the De-facto complainant. Mr. Kallol Mondal, Ld. PP Mr. Suman Chakraborty
……for the State.
Learned advocate appearing for the petitioner claims innocence of the petitioner who is a lady. Learned advocate appearing for the de-facto complainant is present and opposes the prayer for bail and submits that other accused were granted bail. Learned advocate appearing for the State has produced the Statement under Section 164 of the Cr.P.C. of another eye-witness. Having considered the same, I am of the opinion that an anticipatory bail cannot be granted on such materials. Accordingly, prayer for anticipatory bail of the petitioner in CRM (A) 1673 of 2026 is dismissed.
