JUSTICE S VISHWAJITH SHETTY ORAL ORDER This petition is filed under Section 483(i)(b) of BNSS 2023, with a prayer to modify the condition No.(a) imposed by this Court in Criminal Petition No.8904/2026 while granting regular bail to the petitioner vide order dated 28.07.2026. 2. Heard the learned Counsel for the petitioner and learned High Court Government Pleader for the respondent-State. 3. The petitioner had approached this Court in Criminal Petition No.8904/2026 seeking regular bail in S.C.No.1126/2017 pending before the Court of XXVIII Additional City Civil and Sessions Judge, Bengaluru, arising out of Crime No.103/2017 registered by Viveknagar Police Station, Bengaluru, for offence punishable under Section 307 of IPC. The said petition was allowed by this Court - 3 - HC-KAR CNR: KAHC010552892026 NC: 2026:KHC:42405 CRL.P No. 12134 of 2026 vide order dated 28.07.2026 subject to certain conditions. Condition No.(a) imposed by this Court reads as follows: "(a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court." Seeking relaxation of the said condition, the petitioner is before the Court. 4. Learned Counsel for the petitioner submits that though this Court has granted regular bail to the petitioner vide order dated 28.07.2026, till date, the petitioner is in custody since he is not in a position to furnish two sureties for a sum of ₹1,00,000/- as directed by this Court in condition No.(a). Learned Counsel for the petitioner further submits that on the merits of the case, the petitioner was earlier granted regular bail and only for the reason that he had violated the bail conditions and had not appeared subsequently before the Trial Court, he has been remanded to judicial custody in the present case. - 4 - HC-KAR CNR: KAHC010552892026 NC: 2026:KHC:42405 CRL.P No. 12134 of 2026 5. The learned High Court Government Pleader fairly submits that he does not oppose the petition, considering the fact that the petitioner is in custody, though he has been granted bail. 6. Considering the same and also taking into consideration that on the merits of the case, the petitioner was earlier granted regular bail, I am of the opinion that the prayer made in this petition needs to be granted. According, the following: ORDER (i) The Criminal Petition is allowed. (ii) Condition No.(a) imposed by this Court vide order dated 28.07.2026 passed in Criminal Petition No.8904/2026 granting regular bail in S.C.No.1126/2017 pending before the Court of XXVIII Additional City Civil and Sessions Judge, Bengaluru, arising out of Crime No.103/2017 registered by Viveknagar Police Station, Bengaluru, for offence punishable under Section 307 of - 5 - HC-KAR CNR: KAHC010552892026 NC: 2026:KHC:42405 CRL.P No. 12134 of 2026 IPC, is hereby modified and the same shall read as follows: (a) Petitioner shall execute a personal bond for a sum of ₹ 1,00,000/- to the satisfaction of the jurisdictional Court and also furnish cash surety of ₹ 25,000/-.
