Heard Mr.Brajendra Singh, learned counsel for the petitioner as well as Mr.S.S.Baghel, learned Government Advocate appearing for the respondents/State. 2. The present petition has been filed by the petitioner under Article 226 of the Constitution of India with following prayer:- “(i) To issue writ/order to allow this petition, (ii) To issue direction to the Respondent to make payment of the due amount to the petitioner within a maximum period of 120 days from the date of receipt of copy of the order of this Hon'ble Court on this writ petition, (iii) To issue direction to the Respondent to pay interest @ 6 percent per annum on the due amount of the petitioner from the date the amount fell due till the payment is actually made and (iv) To grant any further relief and cost to the petitioner as deemed fit by this Hon'ble Court.” 3. In the present case, there appears to be several defects and learned counsel for the petitioner has not cured the defects till date. 4. At this stage, learned counsel for the petitioner seeks permission of this Court to withdraw this petition with liberty to file a fresh petition curing all defects. 3 5. Permission is granted. 6. Accordingly, the instant petition is dismissed as withdrawn with liberty to file a fresh petition curing all the defects, subject to depositing a sum of Rs.2,000/- as cost by the petitioners in the Registry of this Court and the same shall be transmitted to the Government Special School for Intellectually Retarded Girls, Gangapur, Ambikapur, District Surguja (C.G.). 7. Certified copy of the documents annexed with this petition shall be returned to the counsel for the petitioner after retaining the photocopies of the same.
