1. Two applications are taken up for
consideration analogously as they emanate out of the same police case.
2
2. Memo of evidence in both the applications filed in Court be taken on record.
3. Upon hearing the learned Advocate appearing for the petitioners and the learned Advocate appearing for the State and also going though the materials in the case diary, it transpires that there are allegations of assault as well as extortion of money.
4. Learned Advocate appearing for the State has referred to the statements of the witnesses recorded under Section 180 of BNSS which show that their houses were allegedly looted by the petitioners and others. However, the case diary does not contain details of any contemporaneous complaint over such incident. The incident is alleged to have occurred in the year 2021 and the written complaint was lodged in the year 2026.
5. Considering the aforesaid facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners in both the applications.
6. Accordingly, I direct that in the event of arrest, the petitioners in both the applications shall be released on bail upon furnishing a Bond of Rs.10,000/- (Rupees Ten Thousand Only) each, with two sureties of like amount each, to the satisfaction of the Arresting Officer and subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on condition that the petitioners in both the applications will report before the Investigating Officer once

in a fortnight till the conclusion of the investigation and on condition that the petitioners in both the applications shall appear on every date before the jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioners in both the applications in Court including cancelling the anticipatory bail granted without further reference to this Court.
7. The prayer for anticipatory bail of the petitioners in both the applications is allowed.
8. C.R.M. (A) 2440 of 2026 and CRM (A) 2446 of 2026 are
disposed of.
