Learned advocate appearing for the petitioner submits that the victim/deceased was found hanging. Petitioner has been implicated because of a relationship with the victim. Records of the case reflect that case was initiated on the basis of a direction passed by the learned Magistrate under Section 175(3) of the BNSS. The application under Section 175(3) BNSS reflects that the Inspector-in-Charge, Kharagpur (Town) Police Station on 08.10.2025 after receipt of the information did not take any steps. As such the defacto complainant was forced to go to the Court for obtaining an order.

In view of the manner in which the case was registered, I am of the opinion that, custodial detention of the present petitioner is unwarranted.
As such prayer for anticipatory bail is allowed. As such, I direct that in the event of arrest, the petitioner namely, Om Bhadra be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
As the investigation of the case is in progress petitioner shall, within a period of 10 days, meet with the Investigating Officer of the case and thereafter attend the Investigating Officer as and when called for.
Accordingly, CRM (A) 724 of 2026 is allowed.
Certified copy of the application under Section 175(3) of the BNSS be kept with the record.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
