JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question the proceedings in Crime No.170 of 2024 registered at South Women Police Station, for the offences punishable under Sections 85, 115(2), 352, 3(5) of BNS, 2023 along with Sections 3 and 4 of DP Act. 2. Heard Smt L V Aparna, learned counsel appearing for the petitioner and Smt Deepthi Alva, learned High Court Government Pleader appearing for respondent No.1, Smt Jamuna Bai, learned counsel appearing for respondent No.2 and have perused the material on record. 3. The parties to the lis were also before the Family Court in MC No.3403 of 2025 and have settled the dispute amongst themselves before the Family Court by terms of - 4 - HC-KAR CNR: KAHC010041782025 NC: 2026:KHC:41922 CRL.P No. 984 of 2025 memorandum of settlement. One of the term of memorandum of the settlement is, closure of the present proceedings. The said term in the memorandum of settlement reads as follows: "MEMORANDUM OF SETTLEMENT UNDER SECTION 89 OF CPC READ WITH RULES 24 AND 25 OF THE KARNATAKA CIVIL PROCEDURE (MEDIATIN) RULES, 2005 "The parties above named submit as follows: The petitioner has filed the above petition under Section 13(1) (i-a) of the Hindu Marriage Act, 1955, seeking for decree of divorce against the respondent. I. The aforesaid petition was referred to mediation for resolving the dispute between the parties. In the course of mediation, the petitioner and the respondent along with their respective counsels were present, identified each other and the parties have resolved their disputes by agreeing to the following terms and conditions: 1. The petitioner and the respondent state that their marriage was solemnized on 03.05.2024 at Sambhrama Convention Hall, C A 14/A, 80 feet road, Vijay Nagar, 2nd Stage, Mysore - 570 017, as per Hindu rites and customs. The petitioner is residing at Bengaluru within the jurisdiction of this Hon'ble Court. 2. The petitioner and the respondent state that, due to irreconcilable differences between them and due to incompatibility of temperaments, have been living separately since 15.09.2024. The efforts made by their elders, well-wishers and relatives to reunite them and to bring them under one roof as husband and wife to lead a happy married life did not yield any fruitful result. It is for that reason, they are unable to lead a married life. There is absolutely no chance of re-union amongst themselves. Hence, they have decided to get the - 5 - HC-KAR CNR: KAHC010041782025 NC: 2026:KHC:41922 CRL.P No. 984 of 2025 marriage between themselves dissolved by a decree of divorce as prayed by the petitioner. 3. The petitioner and the respondent state that their marriage is not consummated and no children born to them. 4. The respondent has agreed to pay a sum of Rs.3,00,000/- (Rupees Three Lakhs Only) to the petitioner towards maintenance/permanent alimony as full and final settlement of all her claims by way of demand draft bearing No.027178 dated 30.01.2026 drawn on HDFC Bank, Hosur Branch and the same shall be handed over to the petitioner before the Hon'ble Court at the time of reporting settlement. 5. Both the petitioner and the respondent state and agree that they have no other claims of whatsoever against each other either past, present and future. 6. Both the petitioner and the respondent have already exchanged their valuable articles. 7. Both the petitioner and the respondent state and agree they have no claims over the movable or immovable properties belonging to each other either existing at present or to be acquired in future. 8. In view of the above settlement arrived between the parties, the petitioner has agreed to cooperate for the closure/quashing of the Crime No.170/2024 filed against the respondent and his family members before the South Women's Police Station, Basavanagudi, Bengaluru which is pending before 37th ACMM, Bengaluru and in this regard she undertakes to cooperate with the respondent in Crl Petition No.984/2025 pending before Hon'ble High Court of Karnataka, Bengaluru. 9. In view of this settlement, both the parties withdraw all the allegations made against each other unconditionally. - 6 - HC-KAR CNR: KAHC010041782025 NC: 2026:KHC:41922 CRL.P No. 984 of 2025 10. The petitioner and the respondent state that they have voluntarily agreed to these terms and conditions and there is no coercion, fraud, mistake or undue influence upon either of them to enter into this compromise petition. 11. The petitioner and the respondent hereby agree and undertake not to interfere in the lives of each other in future. II. In view of the aforesaid agreement entered into between the petitioner and the respondent, they pray that this Hon'ble Court be pleased to dissolve the marriage solemnized on 03.05.2024 at Sambhrama Convention Hall, C A 14/A, 80 feet road, Vijay Nagar, 2nd Stage, Mysore - 570 017, in terms of the aforesaid agreement. III. Parties will appear on 02.02.2026 before the Hon'ble Court for passing orders in terms of the agreement." 4. Therefore, in light of the settlement arrived at between the parties quoted supra, I deem it appropriate to terminate the proceedings pending against these petitioners in the subject petition. 5. For the aforesaid reasons, the following: ORDER (i) Criminal Petition is disposed. (ii) Proceedings in Crime No.170 of 2024 registered at South Women Police Station, pending on the file of the 37th Additional CMM - 7 - HC-KAR CNR: KAHC010041782025 NC: 2026:KHC:41922 CRL.P No. 984 of 2025 Court, Nrupatunga Road, Bengaluru, stands quashed, qua the petitioners.
