….for the State. Learned advocate appearing for the petitioners submits that there were previous dispute, pursuant to which petitioners have been foisted with the present criminal case. Learned advocate for the defacto complainant submits that the victim happens to be a deaf girl whose modesty has been outraged. Learned advocate for the State opposes the prayer for anticipatory bail and draws the attention of the Court to the injury report. 2
I have taken into account the nature of the injuries and the fact that complainant and the accused persons are neighbors. Having considered the overall merits of the case, I am of the view that although the investigation should continue but custodial detention may not be warranted. As such, their prayer for anticipatory bail is allowed. As such, I direct that in the event of arrest, the petitioners namely, (1) Nur Alam, (2) Saleman Hoque @ Soleman Ali @ Soleman Hoque, (3) Khalilur Sekh @ Khalil Mahammad be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is in progress, petitioners shall meet with the Investigating Officer within a period of 10 days and on all subsequent dates fixed by the investigating officer of the case. Petitioners, till the charge sheet is submitted, would stay outside the jurisdiction of Raiganj Police Statioin and will enter the jurisdiction only for the purposes of meeting with the Investigating Officer. Accordingly, CRM (A) 2589 of 2026 is allowed. 3
