This is the second bail application of the applicant who has been arrested on 01.06.2026 in connection with Crime No. 171/2022, registered at Police Station – Ambagarh Chauki, District – Mohla Manpur Ambagarh Chauki (C.G.) for the offence punishable under Sections 363, 366 and 376(2)(N) of the IPC and under Section 4 and 6 of the Protection of Children from Sexual Offences Act, 2012. 2. The first bail application has been filed by the applicant for grant of regular bail, which was allowed by this Court vide order dated 27.11.2024 passed in MCRC No. 4771/2024 and the applicant was
directed to be released on bail on furnishing his personal bond with one surety before the learned trial Court.
3. Pursuant to the order dated 27.11.2024, the applicant was released on bail by the learned trial Court. Thereafter, during the trial of the case, the applicant was absconding and could not appear in the proceeding. His non-appearance before the proceeding was culminated into issuance of permanent arrest warrant by the learned trial Court vide
order 25.10.2025 and in pursuance of the permanent warrant of arrest issued against the present applicant, he has been arrested on 01.06.2026 as he himself has surrendered before the learned trial Court and thereafter, he again moved his bail application before the learned trial Court which has been rejected vide order dated 03.07.2026 and then the applicant approached this Court for grant of regular bail.

Learned counsel appearing for the applicant would submit that the present is an offense under Section 363, 366, and 376(2)(N) of the IPC and Section 4 and 6 of the POCSO Act, for which the applicant has been charged. The applicant has got married with the victim of the offense and both of them are started residing at Bangalore. Therefore, he could not appear in the proceeding of the case and the permanent warrant of arrest has been issued against him. He would further submit that the victim has been examined before the learned trial Court as PW-1 and there are material omission and contradiction in her
3 evidence. The trial of the case will take its own time, therefore, the applicant may be enlarged on bail.
5. On the other hand, learned counsel for the State opposes and has submitted that the applicant himself has violated the condition of bail and misused the liberty granted to him, therefore, he cannot be enlarged on bail.
6. I have heard learned counsel for the parties and perused the material annexed with the bail application.

Considering the fact that earlier, vide order dated 27.11.2024, the applicant was granted bail with certain conditions, however, he misused the liberty granted to him and remained absent in the proceeding, therefore, the learned trial Court issued permanent warrant of arrest against him on 25.10.2025 and he could be surrendered on
01.06.2026. Considering the violation of the bail condition by the applicant, in that he remained absconding and permanent warrant of arrest was issued against him, I am not inclined to allow the present application and again release the applicant on bail, as there is every likelihood of his absconding again.
8. Accordingly, the second bail application of the present applicant Deepak Kumar Ambade is hereby dismissed.
9. However, learned Trial Court is directed to expedite the trial of the case and conclude the same as early as possible. Sd/- (Ravindra Kumar Agrawal) JUDGE Sumit
