Learned advocate for the petitioner submits that earlier petitioner had been foisted with number of criminal cases and because of political rivalry he is being implicated in the present case. Learned advocate proposes that neither there has been any seizure from the present petitioner nor from his residence or any of his available places. Learned advocate for the State opposes the prayer for bail and submits Memo of Evidence. On an assessment of the documents which have been placed, I do not find that except the statement of the
2 co-accused person, there are either any materials and/or call data records or any money trail. Having considered the same, I am of the opinion that the petitioner be granted the benefit of anticipatory bail. Hence, the prayer for anticipatory bail of the petitioner is Allowed. Accordingly, I direct that in the event of arrest, the petitioner [Sajahan Sk @ Jiru @ Sajahan Ali] be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge-sheet has been submitted before the learned jurisdictional court, this order of anticipatory bail will remain in force for a period of six weeks from date. Accordingly, CRM (A) 999 of 2026 is disposed of. Memo of evidence and the Supplementary Affidavit filed be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
