The petitioners are apprehending their arrest in connection with Latehar P.S. Case No. 80 of 2024, corresponding to G.R. Case No. 104/2025, registered under Sections 458, 307, 323, 325, 387 and 34 of the I.P.C., pending in the Court of learned Chief Judicial Magistrate, Latehar. 3. Learned counsel for the petitioners submits that allegations are made against the petitioners of interfering with the construction of graveyard. He further submits that petitioners have got no criminal antecedent which is disclosed in paragraph 15 of the application and case diary is also silent with regard to criminal antecedent. He then submits that the matter has been compromised between the parties which has come in para 35 to 39 of the case diary. He next submits that the petitioners have earlier moved before this Court in A.B.A. No. 2749 of 2025, which was dismissed as withdrawn vide order dated 09.06.2025. He submits that however three of the co-accused have been granted privilege of anticipatory bail by this Court in A.B.A. No.5750 of 2025, vide order dated 11.12.2025 and in view of the changed ( 2026:JHHC:393 ) -2- A.B.A. No. 7510 of 2025 circumstance, the second anticipatory bail application has been filed. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail. 4. Learned counsel for the State opposed the prayer and submits that allegations are there of interfering with the construction of graveyard. 5. Considering that petitioners have got no criminal antecedent which is disclosed in paragraph 15 of the application and case diary is also silent with regard to criminal antecedent and further the matter has been compromised between the parties which has come in para 35 to 39 of the case diary and three of the co-accused have been granted anticipatory bail by this Court in the aforesaid A.B.A. and in view of that, the present anticipatory bail application can be entertained. In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners. 6. Accordingly, the above named, petitioners are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (Twenty Five Thousand) each with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Latehar, in connection with Latehar P.S. Case No. 80 of 2024, corresponding to G.R. Case No. 104/2025, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023. (Sanjay Kumar Dwivedi, J.) Dated: 8th January, 2026 Ajay/
