(Oral) The petition under Section 528 Bharatiya Nagarik Suraksha Sanhita, 2023 seeks a direction to official respondents No. 2 and 3 to conduct free and fair investigation through any senior police officer of District Mohali and take appropriate legal action against private respondents by registering FIR under appropriate provisions of IPC. Learned counsel for the petitioner submits that Tej Kaur wife of late S. Bhola Singh died issueless on 28.10.1982. She executed a registered gift deed in favour of petitioner’s father, on the basis of which mutations were duly sanctioned. Private respondents hatched a criminal conspiracy and forged GPA dated 24.05.2023 of Tej Kaur, who died on 28.10.1982. On the strength of the forged power of attorney, various sale deeds were executed in favour of different persons resulting in transfer of land. The matter was reported to the police for registration of FIR and representation (Annexure P-3) was moved to Director General of Police, Punjab but no action was taken. Learned counsel submits that at this stage, petitioner would be satisfied if appropriate direction is issued to the respondent No. 3- Senior Superintendent of Police, Mohali, to AJAY GOSWAMI 2026.07.21 19:42 I attest to the accuracy and integrity of this document CRM-M-39796-2026 (O&M) -2- consider and decide representation (Annexure P-3) moved by petitioner and take necessary action thereupon in a time bound manner. Notice of motion to official respondents only. Mr. Kunwarbir Singh, AAG Punjab, who is present in Court, accepts notice on behalf of the official respondents and submits that petitioner’s representation was received and the matter was under consideration. ID proofs and death certificate of the deceased were being verified and appropriate action would be taken in due course. Keeping in view the limited prayer made by petitioner, the present petition is disposed of with a direction to respondent No. 3- Senior Superintendent of Police, District Mohali, to decide the aforesaid representation (Annexure P-3) submitted by petitioner within a period of 01 month from today by passing a reasoned and speaking order in accordance with law and take necessary action, if so required. However, if, respondent No.3 does not find any substance in the allegations levelled in the representation (Annexure P-3), the petitioner shall be informed as per mandate of law.
