1. The petitioner has filed this petition seeking following relief (s) :
“10.1 That this Hon'ble Court may kindly be
-2- pleased to direct the respondents to promote the petitioner in the vacant promotional post as Lecturer (Panchayat) in Economic subject. 10.2 That, this Hon'ble Court may kindly be pleased to direct the respondents to clear the waiting list, in which petitioner is at place of Serial Number 1, and in regard of 2 vacant post, promoted to the petitioner, in the interest of justice. 10.3 That, any other relief which the Hon'ble Court may deemed fit and proper also be granted to the petitioner, in the interest of justice.”
2. Learned counsel appearing for the petitioner would submit that initially, the petitioner was appointed to the post of Teacher (Panchayat) on 13.02.2006. He would further submit that the name of the petitioner was kept in the wait list at Serial No.1 for promotion to the post of Lecturer, but till date, no decision has been taken. He would contend that the petitioner made various representations, but till date, no decision has been taken. He would further contend that the petitioner may be permitted to make a detailed representation before respondent No.3 and, in turn, the said authority may be directed to decide the same expeditiously, strictly in accordance with law. 3. On the other hand, Mr.
Kumrani, learned Panel Lawyer appearing for the State/respondents would oppose the submissions. He would submit that the order of promotion was issued way back in the year 2016, whereas the petitioner filed this petition only in the year 2018 without explaining the delay. It is also contended that the Teachers (Panchayat) were promoted to the post of Lecturer vide order dated 06.10.2016 and they would have been promoted
3 to the next higher post; therefore, grant of any relief at this stage would hamper their ripened rights. He would contend that this petition deserves to be dismissed. 4. Heard learned counsel appearing for the parties and perused the documents placed on record. 5. Having considered the limited prayer made by the petitioner, this petition, at this juncture, is disposed of reserving liberty in favour of the petitioner to make a detailed representation before respondent No.3 and in turn, said authority is directed to decide the same (if required), preferably within a period of 90 days from the date of receipt of a copy of this order. 6. It is made clear that this Court has not expressed any opinion on the merits of the case. 7. With the aforesaid observation(s)/direction(s), the present petition is disposed of. Sd/-
