This writ petition has been filed under Article 227 of the Constitution of India with the following prayers:-
“(i) Issue a order or direction in the nature of mandamus commanding directing the appellate Court/ Additional Commissioner Garhwal Mandal Camp Dehradun to decide the issue regarding the maintainability of first appeal no. 12 of 2023- 24 Jameel Hasan and others Vs. State of U.K. and others (Annexure no. 3 to this writ petition Page No.30 + 36) and or direct the appellate Court to decide the said appeal expeditiously without any further delay.

(ii) Pass any other writ, order or direction, which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case. (iii) Award the cost of the writ petition to the Petitioner.”

Heard Mr. Lokendra Dobhal, learned counsel for the petitioner, Mr. K.S. Mehta, learned Additional Chief Standing Counsel for the respondent no.6 and Mr. B.S. Adhikari, learned counsel for the respondent no.7.

Mr. Lokendra Dobhal, Advocate, contended that the petitioner, a senior citizen, aged about 68 years, is respondent no.2 in the said appeal. The said appeal has already been admitted.

Mr. K.S. Mehta, Additional Chief Standing Counsel and Mr. B.S. Adhikari, Advocate, have not opposed the prayer of the petitioner.

In the facts and circumstances of this case, this writ petition is disposed of by directing the learned Appellate Court to make an endeavour to decide the First Appeal No.12 of 2023- 2024, “Jameel Hasan and Others vs. State of Uttarakhand and Others” as expeditiously as possible, as per law, without granting any unnecessary adjournment to the parties.
