In Re: An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 read with Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Burdwan Police Station Case No.707 of 2026 dated 30.05.2026 under Sections 448/323/326/379/427/506/34 of the Indian Penal Code;
Salim Sekh @ Nayan & Ors. Versus The State of West Bengal
Mr. Anindya Ghosh Mr. Sourav Mukherjee. …for the petitioners.
Mr. Amitabha Karmakar Mr. Amit Roy. …for the State.
Learned advocate appearing for the petitioners submits that the petitioners have been implicated in the present case because of change in administration.
Learned advocate for the State opposes the prayer for anticipatory bail.
I have taken into account the incident complained of relating to the year 2021 and consequential events. Having considered the same, I am of the view that although the investigation may continue but custodial detention of the present petitioners are unwarranted. As such, the prayer for anticipatory bail of the petitioners is allowed.
