Accused No.3 in Crime No.58/2026 registered by Alanahally Police Station, Mysuru, for the offence punishable under Sections 20(b)(ii)(B) of the NDPS Act, 1985, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.58/2026 was registered by Alanahally Police Station, Mysuru, for the aforesaid offences against Manjunatha and two others based on the first information dated 16.05.2026 received from Shabbir Husein, police officer attached to Alanahally Police Station, Mysuru. In the said case, petitioner, who is arraigned as accused No.3 was arrested on 16.05.2026 and remanded judicial custody. His bail application filed before the Trial Court in Cr.No.58/2026 was rejected on 12.06.2026. Therefore, he is before this Court. 4. FIR in the present case was registered against accused Nos.1 to 3 after they were apprehended based on credible - 3 - HC-KAR CNR: KAHC010444602026 NC: 2026:KHC:42269 CRL.P No. 9445 of 2026 information received and contraband article allegedly ganja totally weighing 10 kgs 90 grams was recovered from their possession. Petitioner has been arrested in the present case along with accused Nos.1 and 2. Seized contraband article is of intermediate quantity and therefore, the rigour under Section 37(1)(b) of the NDPS Act, cannot be made applicable to the present case. Investigation of the case is now completed and charge sheet has been filed. Subsequently, accused Nos.1 and 2 have been granted regular bail by the Trial Court in Special Case No.269/2026 on 07.08.2026. Undisputedly, petitioner has no other criminal antecedents. Under the circumstances, the following order:- 5. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.58/2026 registered by Alanahally Police Station, Mysuru, for the offence punishable under Sections 20(b)(ii)(B) of the NDPS Act, 1985, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the - 4 - HC-KAR CNR: KAHC010444602026 NC: 2026:KHC:42269 CRL.P No. 9445 of 2026 likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
