Status report has been submitted pursuant to the earlier direction passed by the co-ordinate Bench. The report reflects that the sale deed of the seized vehicles was completed between the parties Mahabur Mondal and Suman Swarnakar. The report also reflects that there was no money trail and/or call data records. The subject matter of the present case relates to 139 kgs. of ganja but having regard to the purpose for which the investigating authorities were wanting the custody of the present petitioner, I am of the opinion that the same is unwarranted. As 2 such, the prayer for anticipatory bail of the petitioner is allowed. Accordingly, in the event of arrest, the petitioner, namely, Mahabul Mondal shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge-sheet has already been submitted, this order of anticipatory bail will remain in force for a period of six weeks. Thus, CRM(A)1031 of 2026 is allowed. Status report and Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
