Petitioner was allotted an industrial plot bearing No.IP-16, Gowribidanur Industrial Area, having paid the tentative cost of the plot and having been issued with a possession certificate and lease-cum-sale agreement is before this Court seeking following reliefs: "(a) Issue a Writ of Mandamus to second respondent directing them to execute the sale deed in favour of the petitioner in respect of the industrial land bearing plot No. IP-16, in the Gowribidanur Industrial Area, comprised in Sy. Nos. parts of 18,211 and 313, within the limits of Kudumalakunte village, Kasaba Hobli, Gowribidanur Taluk, Chikkaballapur District, admeasuring 9175 Sq. meters allotted vide registered LEASE CUM SALE AGREEMENT dated 10.12.2012, vide Annexure 'b' beraing Document No. GBD-1-30506- 2012-2013, Book-1, stored in CD No. GBDD 68, - 3 - HC-KAR CNR: KAHC010477272023 NC: 2026:KHC:42904 WP No. 20530 of 2023 dated 26/12/2012, registered in the office of the Sub registrar, Gowribidanur and Possession Certificcate beraing No. IADB/DDO-1/476/2012-2013, dated 10/05/2012 vide Annexure 'C' forthwith. (b) Grant such other further reliefs as this Hon'ble court deems fit, in the facts and circumstances of the case and in the interest of justice and equity." 2. Learned counsel for the respondent-KIADB referring to the document at Annexure-R3 produced along with the statement of objections submits that the petitioner has failed to pay the final differential cost of the aforesaid plot along with the interest. He submits that if the petitioner is ready and willing to pay the final cost of the plot along with the interest, as agreed in terms of the allotment letter dated 29.10.2011 as per Annexure-A, the request of the petitioner would be considered. 3. In response, learned counsel for the petitioner submits that petitioner is ready and willing to pay the final cost of the plot along with the interest, as agreed in terms of the allotment letter dated 29.10.2011 as per Annexure-A and seeks for a direction to be issued to the respondent No.2-KIADB to accept the payment to be made by the petitioner, in terms of Annexure-R3. 4. Petitioner is at liberty to pay the amount as demanded by the respondent No.2-KIADB along with the interest in terms of the allotment letter dated 29.10.2011 as per Annexure-A. If such payment is made within an outer limit of two months from the date of receipt of certified copy of this order, respondent No.2- KIADB shall proceed to complete the transaction in accordance with law within an outer limit of two months thereafter.
