Goswami, learned Addl. P.P appearing for the State. The CD has been produced by the learned Addl. P.P. The FSL report is still awaited. Page No.# 2/3 The learned counsel for the petitioner has submitted that this the first time the petitioner has been taken into custody. The learned counsel for the petitioner has submitted that the petitioner is a permanent resident of the area and would not hamper or tamper with the investigation if allowed the privilege of bail. The learned Addl. P.P has objected to the prayer stating that the ground of arrest reflected and it is noticed that the CD reflected that the accused had tried to escape and thereafter he was apprehended, therefore, allowing the petitioner to go on bail at this stage would hamper or tamper the investigation. The petitioner has been custody for the last 52 days. In view of the submission made by the learned counsel for the petitioner, this Court is of the opinion that in the circumstances, the petitioner can be allowed the privilege of bail under strict conditions so that he may not hamper or tamper the investigation and will be available as when required for investigation. In such circumstances, it is provided that the petitioner shall be released on furnishing a bail bond Rs. 50,000/- with two sureties of the like amount, out of which, one of the sureties should be a Government employee of the State of Assam, to the satisfaction of learned Special Judge, Kamrup, Amingaon, Assam in connection with Chhaygaon P.S Case No. 01/2026 u/s 21(b)/29 of NDPS Act if not wanted in connection with any other cases subject to the following conditions; a) shall not leave the territorial jurisdiction of the learned jurisdictional Court without prior written permission from him/her till disposal of the case; (b) shall co-operate with the investigation as and when required, (c) shall regularly attend the trial court and cooperate with the court for early disposal of the case; and (d) shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court. The observation made by the Court is for the purpose of this bail application only, not on merits of the case. Violation or breach of any condition(s) shall render cancellation of the bail.
