Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a WRIT OF MANDAMUS or any other appropriate writ or direction declaring that the actions of the respondents in withholding of bills amount of Rs.30,00,000/-, dated 09.01.2015 and Rs.20,51,344/- dated 17.12.2021 in total Rs.50,51,344/- even after finalizing the bills amount in connection with work i.e., Restoration of UGD and water supply trenches with B.T. Hot mix process, construction and repairs of drains in P.R.K. Building area and H.B. Colony, Phase-1 area in 28th division - RC.E6-129255/10 under Agreement No.61/2010-11, dated 30.09.2010 is questioned as the same is illegal, arbitrary and unconstitutional and consequently direct the respondents to consider the payment of two bills amount of Rs.50,51,344/- payable to the petitioner by the respondents and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to pay the two bills amount of Rs.30,00,000/-, dated 09.01.2015 and Rs.20,51,344/- dated 17.12.2021 in total Rs.50,51,344/- payable to the petitioner by the respondents in respect of work i.e.,

Order:-
The learned counsel for the petitioner submits that the petitioner was entrusted with the work of Restoration of UGD and water supply trenches with B.T. Hot mix process, construction and repairs of drains in P.R.K. Building area and H.B. Colony, Phase-1 area in 28th division - RC.E6-129255/10 under Agreement No.61/2010-11, dated 30.09.2010.
2. It is submitted that the petitioner had completed the work entrusted to him and that the competent authority of the respondents had also approved the payments due and payable to the petitioner. The respondents have also recorded the progress of the work and the amounts due and payable to the petitioner in the M-Book.
3. Heard the submissions of the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration and Urban Development Department, Sri S.V.S.S. Siva Ram, learned Standing Counsel for the respondent Nos.3 to 5 and the learned Assistant Government Pleader for Finance and Planning.
4. During the course of hearing, the learned Standing Counsel appearing for the respondent Nos.3 to 5, on written instructions, submits that the bills were approved for clearance and funds were also released by the Government for clearing the outstanding bills of the contractors. It is also submitted that further funds are awaited and, soon after the release of the funds, the bills due and payable to the petitioner shall be cleared.

Recording the submissions, this writ petition is disposed of at the admission stage, directing the respondents to verify and release the payments due and payable to the petitioner as expeditiously as possible, preferably within a period of ten (10) weeks from the date of receipt of a copy of this
order. There shall be no order as to costs.
6. Pending miscellaneous petitions, if any, shall stand closed.
