The applicant has preferred this First Bail Application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 358/2025, registered at Police Station : Baikunthpur VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2026.08.10 11:58:26 +0530 2 District - Korea (C.G.) for the offence punishable under Sections 111, 317(2), 317(4) & 317(5) of the BNS. 2. Case of the prosecution in brief is that, on the basis of information received from the National Cyber Crime Reporting Portal, Cyber Cell, District Korea conducted inquiry regarding cyber fraud transactions. During inquiry it was found that amounts obtained through cyber fraud were allegedly transferred through various bank accounts maintained in different banks. It is alleged that the present applicant Ravishankar Rajwade was holding Savings Bank Account No. 5770452307 in Central Bank of India, Branch Baikunthpur, and that amounts received from different States were credited into the said account. Upon obtaining and examining the transaction details of the said account, it was found that amounts were received from different states. It is alleged that, the applicant provided his bank account to certain offenders/group for the purpose of earning illegal money through online fraudulent activities. The applicant has not disputed that the said bank account belongs to him. On the basis of account statements, transaction details and information collected during investigation, Police Station-Baikunthpur registered Crime No.358/2025 for the offences punishable under Sections 111, 317(2), 317(4), 317(5) of B.N.S., 2023 against the present applicant and 9 other co-accused persons. Thereafter, the applicant arrested on 15.11.2025, and after completion of investigation the charge-sheet has been filed for the offences 3 punishable U/s-111, 317(2), 317(4), 317(5) of B.N.S. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and that there is no material in the charge-sheet showing his active involvement in the alleged offence, except that certain amounts were credited into his bank account through two transactions, which by itself does not establish his knowledge or participation in the alleged fraud. It is further submitted that the entire case is based on documentary evidence, which is already in the custody of the Investigating Agency, and therefore, no custodial interrogation is required. Learned counsel further submits that out of 11 prosecution witnesses, 5 witnesses have already been examined, and they have not supported the prosecution case against the applicant. It is also submitted that other co-accused have already been granted bail by this Court. The applicant is aged about 25 years, is the sole earning member of his family, has been in custody since 15.11.2025, and the charge-sheet has already been filed; therefore, his further detention would serve no useful purpose and the trial is likely to take considerable time. The applicant is a permanent resident, there is no likelihood of his absconding or tampering with the prosecution evidence, and he undertakes to abide by all the conditions imposed by this Hon’ble Court. 4. Learned State Counsel opposes the bail application and submits that, although the charge-sheet has been filed, the investigation 4 reveals that amounts obtained through cyber fraud were credited into the applicant’s bank account. It is submitted that complaints were received on the National Cyber Crime Reporting Portal regarding fraudulent transactions of Rs.20,000/- and Rs.48,000/- credited into the said account. The account had total credits of Rs.1,15,406/- and was allegedly used for fraudulent transactions. Learned State Counsel further submits that the applicant, along with other accused persons, facilitated the use of the bank account for committing cyber fraud and deceiving innocent persons. Therefore, considering the nature of the allegations and the material collected during investigation, the applicant is not entitled to the grant of regular bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Having considered the rival submissions and perused the case diary and material available on record, this Court finds that there is prima facie material showing that amounts obtained through cyber fraud were credited into the bank account of the applicant and that the said account was allegedly used for fraudulent transactions. The allegations involve cheating of innocent persons through cyber means and financial transactions connected with the alleged offence. Merely because the charge- sheet has been filed does not by itself entitle the applicant to bail. Considering the nature and gravity of the allegations and the prima facie material available against the applicant, this Court is 5 not inclined to grant bail. Accordingly, the bail application is rejected. 7. Accordingly, the bail application of the applicant – Ravishankar Rajwade involved in Crime No. 358/2025, registered at Police Station : Baikunthpur District - Korea (C.G.) for the offence punishable under Sections 111, 317(2), 317(4) & 317(5) of the BNS , is rejected 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
