1. The revisonal application has been preferred praying for quashing of the proceedings in connection with GR no. 1675 of 2024 arising out of Lake Town Police Station case no. 451 of 2024 dated 9.12.2024 under sections 79/115(2)/117(2)/126(2)/329(2)/351(2)/3(5) of BNS, 2023, culminating into charge sheet being Charge sheet no. 455 of 2024 dated 9.12.2024 under sections 79/115(2)/117(2)/126(2)/329(2)/351(2)/3(5) of BNS, 2023, presently pending before the learned Additional Chief Judicial Magistrate, Bidhannagar, North 24 Parganas.

Upon hearing, the learned counsel for the petitioners and on perusal of the materials on record and also the allegations as made in the written complaint, it appears that the complainant is the wife of the brother of the petitioner no. 2, the petitioner no. 3 is the son of the petitioner no. 2 and the petitioner no. 1 is the cousin of the petitioner no. 3.
3. It prima facie appears that there is a family dispute and considering the nature of allegations made in the written
2 complaint, this court finds that the petitioners herein have made out a prima facie case for quashing and accordingly the revisional application is required to be heard in presence of both the opposite parties.
4. Petitioners will serve a copy of the application upon the opposite parties including the State of West Bengal, who shall produce the case diary on the next date of hearing.
5. Having heard learned counsel for the petitioners, let the proceedings being GR no. 1675 of 2024 arising out of Lake Town Police Station case no. 451 of 2024 dated 9.12.2024 under sections 79/ 115(2)/ 117(2)/ 126(2)/ 329(2)/ 351(2)/ 3(5) of BNS, 2023, culminating into charge sheet being Charge sheet no. 455 of 2024 dated 9.12.2024 under sections 79/115(2)/117(2)/126(2)/329(2)/351(2)/3(5) of BNS, 2023, presently pending before the learned Additional Chief Judicial Magistrate, Bidhannagar, North 24 Parganas be stayed till 30th September, 2026 or until further order, whichever is earlier.
6. Let the matter appear before the Regular Bench.
