In the present petition, the prayer of the petitioner is for enhancement of the rate of interest awarded on the delayed release of pensionary benefits to 12% per annum from 6% per annum, which was granted to the petitioner vide the impugned order dated 07.04.2025 (Annexure P-1) passed by the Central Administrative Tribunal, Chandigarh Bench, Chandigarh (hereinafter referred to as "the Tribunal"), in O.A. No. 539 of 2023. 2. After arguing for some time, learned counsel for the petitioner submits that keeping in view the provisions of Section 34 of the Code of Civil Procedure, 1908, the maximum rate of interest that can be awarded on the delayed release of payment is 6%, which has already been granted to the petitioner by the Tribunal while passing the impugned order dated 07.04.2025 (Annexure P-1).
