Ankita Paul Ms. Sreyashee Biswas Ms. Manisha Ghosh ..for the petitioner This application under Article 227 of the Constitution of India is at the instance of the husband praying for a direction upon the learned Additional District Judge, 13th Court at Alipore, 24 Parganas (South) to dispose of the Matrimonial Suit No. 2945 of 2025 expeditiously. The learned advocate appearing for the petitioner submits that the petitioner and the opposite party filed a joint petition under Section 28 of the Special Marriage Act praying for dissolution of marriage by mutual consent. She further submits that several dates were fixed for appearance of the parties but the matter is yet to be taken up for hearing and disposed of. From the ordersheets appended to this application this Court finds that 13th October, 2026 is fixed for hearing and for passing orders. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate on record of the petitioner shall be obliged to 2 forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submissions made by the learned advocate for the petitioner, C.O. 2429 of 2026 stands disposed of by requesting the learned Additional District Judge, 13th Court at Alipore, 24 Parganas (South) to take up the hearing of the application for dissolution of marriage with mutual consent on the next date fixed i.e. on 13th October, 2026 and to dispose of the same as expeditiously as possible but preferably by the end of the month of November, 2026 without granting any unnecessary adjournments to either of the parties. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
