Order on Board 20/08/2026 1 This contempt petition under Section 12 of the Contempt of Courts Act, 1971, read with Article 215 of the Constitution of India, has been preferred by the applicant alleging non-compliance of the order dated 21-4-2025 (Annexure C-2) passed in WPS No. 2617/2025. 2
Learned counsel for the applicants would submit that the applicants were appointed to the post of Data Entry Operator in Government Medical College, Ambikapur, purely on a contractual basis in the year 2020. Thereafter, period of their contractual appointment has been extended from time to time and vide order dated 2-4-2025, their service period was further extended for the
3 period till 31-3-2026. However, the extension was cancelled vide
order dated 3-4-2025 (Annexure C-1), on the ground that the requisite funds had not been received from the Government. The said order has been stayed by the Coordinate Bench vide order dated 21-4-2025 passed in WPS No. 2617/2025, even then, the applicants have not been kept in service and salary is not being paid to them. Hence, he submits that, contempt proceeding be initiated against the respondents. 3 On the other hand, learned counsel for the respondents submits that the contractual appointment of the applicants was not against any sanctioned post and the salary of the contractual employee was being paid from funds received from the State Government from time to time. Since, after completion of the applicants’ tenure on 31-3-2025, no sanction was received from the State Government for continuation of their contractual appointment, the extension of their appointment was cancelled. He further submits that, in view of the aforesaid facts, the respondents have filed an application before the Coordinate Bench in WPS No. 2617/2025 seeking vacation of the interim order. Since the aforesaid application for vacating the stay has already been filed on 23-7- 2026, he prays that the present contempt proceeding may be dropped at this stage.
4 4 Having considered the aforesaid submissions of learned counsel for the respondents, particularly the fact that an application for vacating the stay has already been filed in the WPS No. 2617/2025, this Court is not inclined to keep the instant contempt petition pending. Accordingly, this contempt petition is disposed of with liberty to the applicants to raise their grievance, if any, after the Coordinate Bench passes an order on the application filed by the respondents for vacating the stay. 5 The rule issued to the respondents is discharged and the contempt proceedings is dropped.
