Mr. Malay Bhattacharya Mr. Soujanya Das Mr. Kazi Najesh Haque ….for the petitioner Mr. Guddu Singh ……for the State respondents 1) Affidavit of service filed on behalf of the petitioner is taken on record. 2) By presenting this writ petition, petitioner prays for direction upon the concerned police authorities to take the investigation to its logical conclusion expeditiously by taking necessary steps. Prayer is also made for extending police assistance to the petitioner during investigation. 3) State respondents are represented by learned advocate. 4) It has been decided by the Hon’ble Supreme Court in the judgment reported in 2026 SCC OnLine SC 798 (Sujal Vishwas Attavar and Another Vs. State of Maharashtra and Others) that even after registering FIR if investigation is not being carried out appropriately in that event party needs to approach within statutory framework before jurisdictional 2 Magistrate under Section 175 (3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 5) Petitioner, if finds that investigation is not appropriately carried out in Burdwan Police Station Case No. 712 /2026 dated 31st May, 2026 in that event petitioner needs to approach jurisdictional Magistrate. 6) In view of availability of alternative remedy, present writ petition is not interfered with and same stands dismissed. 7) However, this order shall not preclude the petitioner to approach jurisdictional Magistrate in pursuit of remedy. 8) Concerned police authorities are directed to maintain peace and tranquility at the locale. 9) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
