Respondent(s) For Petitioner(s) : Suresh Kumar Jagatramka, Petitioner in person For Respondent No.4 : Mr. N.K.Malviya, Advocate For Respondent No.7 : Ms. Aparajita Pandey, Advocate For Respondent No.8/State : Ms. Richa Sahu, PL (Hon’ble Shri Justice Ravindra Kumar Agrawal) Order on Board 06/08/2026 Present writ petition has been filed by the petitioner, appearing in person, under Article 227 of the Constitution of India assailing the impugned memo dated 15.07.2025 issued by the Third District Judge, Raigarh, in Civil Suit No. A/8/2021, whereby extension of time was sought for disposal of the said civil suit. 2. The petitioner, appearing in person, submits that in the impugned memo dated 15.07.2025, the learned trial Court sought extension of time by recording, in Column No. 7 of the request letter, that the petitioner had repeatedly sought adjournments and, therefore, the suit could not be decided within the stipulated period. It is contended that the petitioner has been diligently cooperating with the proceedings and 3 has never sought any unnecessary adjournment. According to him, the aforesaid observation is factually incorrect and, if allowed to remain on record, may prejudice his rights in the pending proceedings. It is further submitted that, by order dated 30.07.2025 passed by the Coordinate Bench of this Court in M.C.C. No. 760 of 2025, the period for disposal of the civil suit has already been extended by six months. Accordingly, the petitioner confines his prayer to expunging the aforesaid observation contained in the memo dated 15.07.2025. 3. Per contra, learned counsel appearing for the respective respondents oppose the writ petition and submit that the memo dated 15.07.2025 was merely a request seeking extension of time, which has already been considered and acted upon by the Coordinate Bench of this Court. Consequently, the present writ petition has been rendered infructuous. 4. I have heard the petitioner, appearing in person, as well as the learned counsel appearing for the respective respondents. 5. On a perusal of the pleadings and the relief sought in the present writ petition, it is evident that the petitioner has challenged the request letter dated 15.07.2025 whereby the learned trial Court sought extension of time for disposal of Civil Suit No. A/8/2021. The petitioner has also placed on record, as Annexure P/4, the order dated 30.07.2025 passed by the Coordinate Bench of this Court in M.C.C. No. 760 of 2025, whereby the period for disposal of the said civil suit was extended by six months, with a further direction that the parties 4 shall not seek unnecessary adjournments. 6. In view of the order dated 30.07.2025 passed by the Coordinate Bench in M.C.C. No. 760 of 2025, the request letter dated 15.07.2025 already stands considered and acted upon. Therefore, no further orders are called for in respect of the said request letter. Accordingly, the present petition is disposed of. 7. However, so far as the observation recorded in Column No. 7 of the request letter dated 15.07.2025 is concerned, it is clarified that the learned trial Court shall proceed with the trial of Civil Suit No. A/8/2021 in accordance with law, uninfluenced by the observation recorded in Column No. 7 of the said request letter.
