In the impugned judgment and order, the Writ Court disposed of the writ petition directing the petitioner to pay guidance value as conceded by him in paragraph No.2 and the Deputy Commissioner is directed to take - 3 - HC-KAR CNR: KAHC010318212026 NC: 2026:KHC:39407-DB WA No. 1367 of 2026 decision on the recommendation, for issue of certificate of permanent ownership in a time bound manner. 3. The parties are referred to as per their ranking before the Writ Court. 4. Heard Sri.M.N.Sudev Hegde, learned Additional Government Advocate for appellant. 5. Though in a feeble voice Sri.Hegde submits that amount be fixed as per the market value rather the guidance value, however, this Court consistently has considered that the value be taken is the guidance value in terms of sub-rule (4) of Rule 43-H of the Karnataka Land Revenue (Amendment) Rules, 19601. 6. This Court in STATE OF KARNATAKA AND OTHERS Vs. SRI.O.GOPALAKRISHNA BHAT2, has fixed the guidance value as the value for the purpose of 1 'the Rules of 1960', for short 2 W.A.No.416/2025 Dt: 08.07.2026 - 4 - HC-KAR CNR: KAHC010318212026 NC: 2026:KHC:39407-DB WA No. 1367 of 2026 payment under sub-rule (4) of Rule 43-H of the Rules of 1960, for the purpose of permanent occupancy. 7. In that view of the matter, we find no infirmities in the judgment and order passed by the Writ Court and accordingly, we dispose of this writ appeal.
