Learned advocate appearing for the petitioners submits that the petitioners are in custody for about 8 months and the case was registered on 16.12.2025 and charge-sheet was submitted on
31.12.2025.
Learned advocate for the State has produced the case diary.
I have taken into account the materials appearing in the case diary and I am not satisfied in respect of the fact that why charge-sheet was submitted within 15 days without any substantial materials being collected by the investigating agency. Having regard to the case which is presently pending and the petitioners are in custody for about 8 months, I am inclined to release the petitioners
2 on bail. As such, the prayer for bail of the petitioners is allowed.
Accordingly, the petitioner no.1, namely, Abu Bakkar @ Abu Bakar @ Abu Babar, the petitioner no.2, namely, Md. Jorif @ Md. Sarif, the petitioner no.3, namely, Sajeev and the petitioner no.4, namely, Rofik @ Rafik shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned CJM, Uttar Dinajpur. If on bail, the petitioners shall be physically present on each and every date before the learned trial court and shall not leave the district of Uttar Dinajpur without prior permission of the learned court in seision of the case.
With the aforesaid observations, CRM(M)990 of 2026 is allowed.
Memo of Evidence submitted by the State be kept with the record.
