ORAL ORDER
1. There has been a dispute between the petitioner-Bank and respondent no.2, who was its employee. 2. Respondent No.2 raised a dispute before the Joint Registrar of Co-operative Societies and an award was passed in Dispute No.JRD/UBF/1255/2004-05 in his favour on 03.10.2005 [vide Annexure-A to the writ petition]. The same was challenged by the petitioner before the Appellate Tribunal and an order was passed in its favour. Aggrieved by the same, respondent no.2 preferred W.P.No.21014/2009 before this Court and the same came to be dismissed by order dated 18.08.2010. 3. Thereafter, respondent no.2 intended to approach the Civil Court to redress his grievance, and hence, he requested respondent no.1 to issue a certificate. Respondent no.1 has issued a certificate in favour of respondent No.2 (vide Annexure-H to the writ petition), which reads as under:

4. Subsequent to issuance of such a certificate, respondent no.2 has approached the Civil Court by filing an original suit, which is said to have been dismissed. 5.
On the ground that the said award passed in favour of respondent no.2 has ultimately culminated in favour of the petitioner [vide order passed in W.P.No.21014 of 2009], the petitioner has filed the instant petition with the following prayers:
"i) Issue a writ in the nature of certiorari to quash the impugned certificate bearing No.ARE/UBF/52/2025-26 dated 03/06.10.2025, issued by the 1st respondent (vide Annexure-H) to recover the Award passed in Dispute No.JRd/UBF/1255/2004-05 dated 30.10.2005 (correct date is 03.10.2025) (vide Annexure-A) through Civil Court as illegal, arbitrary and not sustainable in the eye of law and; and

ii) To declare that the award dated 03.10.2005 passed inJRD/UBF/1255/2004-05 (vide Annexure-A) by Joint Registrar of Co-operative Society, Mysuru has attained its finality and the 2nd respondent cannot execute the same under the provisions of KSC Act, 1969; and iii) Grant such other relief/s as deems fit by this Hon'ble Court considering the facts and circumstances of the present case including the heavy costs on respondent No.2, in the interest of justice and equity."

The case of the petitioner is that, by virtue of the award passed in Dispute No.JRD/UBF/1255/2004-05 having been reversed and the proceedings having ultimately culminated in favour of the petitioner herein, the question of issuance of an endorsement/certificate at Annexure-H to the writ petition in favour of respondent no.2 does not arise. 7. The aforementioned facts are not disputed by respondent no.2. However,
learned counsel for respondent No.2 justifies the endorsement/certificate

issued by respondent no.1 and prays for dismissal of the writ petition.
8. Admittedly, the proceedings in No.JRD/UBF/ 1255/2004-05 has culminated in favour of the petitioner herein. However, respondent no.2 submits that the said proceedings are still pending. It is, however, admitted that presently no order exists in favour of respondent no.2.
9. The impugned endorsement/certificate (vide Annexure- H to the writ petition) is in the nature of enforcement of an award, which is presently overturned in favour of the petitioner. Under the said circumstances, respondent no.1 ought not to have issued the impugned endorsement/certificate.

ORDER (i) The impugned endorsement/certificate dated 03.10.2025 bearing No.ಎಆ ಎಆ ಎಆ ಎಆಇಇಇಇ/ಯುಎ ಯುಎ ಯುಎ ಯುಎ
/52/2025-26 issued by respondent No.1 is hereby set aside; (ii) It is hereby clarified that if respondent No.2 succeeds in obtaining any favourable order against the petitioner from the appropriate Court in accordance with law, he would be entitled to have the same enforced in law.
