1. Mr. Chowdhury, learned advocate appears for the contempt applicants in CPAN 2 of 2025 and submits that though the new incumbent/alleged contemnor has communicated an order, said to be in terms of this Court’s order dated 23.08.2024 in WPA 8510 of 2021, the same is neither a reasoned order nor has been passed in
consideration of the applicable rules.
2. In contempt jurisdiction, this Court is duty bound to look into whether the direction of the Court is complied with by the alleged contemnor
2 or not, without being motivated about its legality or impropriety etc.
3. Keeping that principle in mind, it is found that the direction by the Court to pass a reasoned
order after considering all the petitioners’ representation has been complied with by the alleged contemnor by issuing an order dated
05.08.2026.
4. It is not the applicants’ case that no opportunity of hearing was allowed to them by the alleged contemnor.
5. Therefore, in the instant contempt applications, I do not find any point for adjudication remaining any further keeping the instant matters pending.
6. Hence, upon finding due compliance of the Court’s order dated 23.08.2024 in WPA 8510 of 2021, the present contempt applications being CPAN 2 of 2025 and CPAN 87 of 2025 stand
disposed of.
7. Let it be mentioned that contempt applicants are at liberty to espouse their rights to challenge the impugned order, if so advised.
8. Urgent photostat certified copy of this order, if applied for, be given to its parties on usual undertaking.
