This criminal revision is filed under Section 102 of the Juvenile Justice (Care and Protection of Children) Act, 2015 being aggrieved by the impugned order dated 29.05.2026 passed by the learned Additional Sessions Judge (FTC), Durg, District – Durg (C.G) in Criminal Appeal No.179/2026, arising out of order dated 15.05.2026 in Crime No. 03/2026 passed by learned Principal Judge, Juvenile Justice Board, Durg, District - Durg (C.G.).

As per the brief facts of the prosecution case, on 02.01.2026, the police of Police Station Jamul, upon receiving secret information regarding the alleged illegal possession and sale of narcotic substances at a rented house situated behind Kurud High School, Dhacha Bhawan, conducted a PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.08.19 16:09:22 +0530
2 raid in the presence of independent witnesses. During the search, co-accused Rajji Kaur and her son, Kishan Singh, were found present at the premises. The police allegedly recovered 33.36 grams of heroin (chitta), 281.85 grams of doda, cash amounting to Rs.8,90,400/-, and three mobile phones from the said premises. The seized articles were weighed, sealed, and taken into custody after preparation of the requisite panchnamas, and the accused persons were arrested on the same day. Accordingly, an FIR was registered at Police Station Jamul, District Durg (C.G.), for offences punishable under Sections 21(b), 27(a), and 8 of the Narcotic Drugs and Psychotropic Substances Act, 1985. During the course of investigation, the present applicant was implicated in the case on the basis of the memorandum statements of the co-accused persons.

Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in the present case. He also submits that the applicant is a juvenile and the applicant has no criminal antecedents. He also submits that that there is no seizure from the present applicant. Further, co-accused, namely, Kishan Singh has been granted regular bail by this Court vide order dated 15.06.2026 passed in MCRC No. 2435/2026. Hence, he prays for grant of bail on the ground of parity.
4. On the other hand, learned State counsel opposes the submission made by learned counsel for the applicant but could not dispute the fact that co-accused person has already been granted regular bail by this Court.
5. I have heard learned counsel for the parties and perused the records.
6. From perusal of records, it appears that the applicant is a juvenile, and there is no criminal antecedents against him prior to this case and further, co-accused, namely, Kishan Singh has been granted regular bail by this
3 Court vide order dated 15.06.2026 passed in MCRC No. 2435/2026, thus I am inclined to allow this criminal revision on the ground of parity.
7. Consequently, criminal revision is allowed. The judgment dated dated 29.05.2026 passed by the learned Additional Sessions Judge (FTC), Durg, District – Durg (C.G) in Criminal Appeal No.179/2026, arising out of
order dated 15.05.2026 in Crime No. 03/2026 passed by learned Principal Judge, Juvenile Justice Board, Durg, District - Durg (C.G.), and all consequential proceedings arising thereof, are set aside. It is directed that on furnishing a local surety of Rs. 50,000/- along with a bond of same amount which are to be of his natural guardian/father/mother, to the satisfaction of the concerned Juvenile Justice Board, for this appearance as when directed, the applicant shall be given in custody of his natural guardian/father/mother.
