Earlier application was dismissed as infructuous vide order dated 30.04.2026 passed in MCRCA No.470/2026. 2. As per the prosecution, the Applicant was working under co- accused Karunakar Upadhyay and Anita Upadhyay and was allegedly acting as the State Head of Rashtriya Gramin Saksharta Mission and in that capacity, the Applicant along with the co-accused induced the complainant to deposit Rs.25,00,000/- towards security amount and Rs.55,500/- towards tender charges in connection with the proposed supply of sweaters. It is further alleged that the co-accused entered into a registered agreement with the complainant for supply of clothes and sweaters and thereafter, in January, 2025, co-accused Anita Upadhyay issued a cheque of Rs.5,29,20,000/- in favour of the complainant, which was dishonoured, pursuant to which the present FIR was registered against the Applicant and the other co-accused persons. Hence, this application. 3 3. At the outset, learned State Counsel points out that the Applicant had earlier preferred an anticipatory bail application i.e. MCRC No.470/2026, which on 30.04.2026, was dismissed as infructuous on the submission made by learned Counsel for the Applicant Mr. Sudhir Sharma that the Applicant had already been arrested. Copy of the said order has been filed as Annexure A-2. 4. Learned Counsel for the Applicant submits that the earlier application was dismissed as infructuous due to a miscommunication that the Applicant had been arrested in the present case. He further submits that the Applicant is presently in custody in connection with a similar case registered in Delhi and has not yet been granted bail by the competent Court in the said case. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the submissions advanced by learned Counsel for the parties, the material available in the case diary, the fact that the Applicant had earlier preferred anticipatory bail application MCRC No.470/2026 which was dismissed as infructuous on the submission that he had already been arrested and in view of the same, the Applicant has been 4 arrested in the said case and is also wanted in the present case, this Court is not inclined to extend the benefit of anticipatory bail to the Applicant. 7. Accordingly, the Anticipatory Bail application of the Applicant –Saurabh Singh, filed under Section 482 of the BNSS, 2023 in connection with Crime No. No.86/2025, registered at Police Station – Pathalgaon, District Jashpur (C.G.) for alleged commission of offences punishable under Sections 316(2), 316(5), 318(4), 336(3), 338, 340(2), 341(1), 346 and 61(2) of BNS is hereby rejected. 8.
