This first anticipatory bail application under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.230/2026 registered at Police Station – Nandini Nagar, District Durg (C.G.) for offence punishable under Section 69 of KRISHNA KUMAR BARVE Digitally signed by KRISHNA KUMAR BARVE Date: 2026.08.17 15:58:20 +0530 2 Bharatiya Nyaya Sanhita (for short ‘BNS’). 2. The prosecution story, in brief, is that the victim submitted a written complaint to the Nandini Nagar police station stating that on 27.05.2026, she met Ritesh Sahu, alias Rinku, through Instagram. During their conversation, the accused lured her to his home, expressed his love and promised to marry. On 16.06.2026, the accused took her to his home, where he had physical relations with her on the pretext of marriage. Subsequently, he had physical relations with her on 25.06.2026 at his home and on 01.07.2026 in a village field, under false promises of marriage. Later, when the victim asked for marriage, the accused refused, disconnected his mobile phone, and severed contact with her. The victim alleged that the accused deceived her by having physical relations with her under false promises of marriage. Therefore, legal action should be taken against him. Based on the victim’s written complaint, a case was registered against the applicant. Hence, the bail application. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. He further submits that the victim and the applicant were in relationship and their relations were consensual and subsequent breach of promise to marry does not constitute an offence under Section 69 of the BNS. Therefore the applicant be released on bail. 3 4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail to the applicant. However, he submits that in her statement recorded under Section 183 of the BNSS, the victim has stated that on 16.6.2026, there was function in Raveli and the applicant visited the house of the victim to take her to participate in the said function. Thereafter the applicant took her to his house and on the pretext of marriage, developed physical relations with her. On 25.6.2026, the victim met the applicant in his house where the applicant developed physical relations with her. Again on 1.7.2026, the applicant developed physical relations with her. 5. I have heard learned counsel for the parties and perused all of the documents taken on record. 6. Considering the facts and circumstances of the case, particularly considering that the applicant and the victim were in relationship and their appears appear to be consensual, the victim is a major girl and further considering the statement of the victim recorded under Section 183 of the BNSS, this Court is inclined to extend the benefit of anticipatory bail to the applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Rinku @ Ritesh Kumar Sahu, on executing a personal bond with one surety in the like sum to the satisfaction of the Arresting Officer, he shall be released on bail on the following conditions:- 4 (a) He should not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) He should not act in any manner which will be prejudicial to fair and expeditious trial. (c) he should appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The Applicant and the sureties shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
