According to petitioner, family pension has not been paid to her so far, even though she is entitled to such benefit. (3) Learned State Counsel submits that at the time of his death, petitioner’s husband was not a regular employee and he was continuing as seasonal employee. He further submits that son of petitioner was given compassionate appointment in view of the order of this Court, passed in WPSS No. 2011 of 2016. (4) Learned Counsel for the petitioner submits that petitioner has made representation to Sub Divisional Magistrate, Haridwar, who may be directed to take decision thereupon. (5) Learned State Counsel submits that he has no objection if the competent authority is directed to take decision on petitioner’s representation. (6) Learned Counsel for the petitioner submits that petitioner be permitted to make fresh representation to District Magistrate, who may be directed to take decision thereupon. (7) Writ petition is, accordingly, disposed of with liberty to petitioner to 2026:UHC:2631 move representation to District Magistrate concerned regarding family pension. If she makes such representation within two weeks from today, decision thereupon shall be taken, as per law, within three months thereafter.
