ORAL JUDGMENT (PER: HON'BLE MR. JUSTICE D K SINGH)
The present intra-court appeal has been filed impugning the order dated 03.07.2026 passed by the Writ Court in W.P.No.16539/2026.
2. The parties are referred to as per their ranking before the Writ Court.
3. The petitioner/appellant had filed the Writ Petition for following prayer:
"a) Issue Writ of CERTIORARI by quashing the impugned Order of transfer dated 30-05-2026 bearing No.2159019/DMA/EST2/TRF/2/2026 passed by the 2nd Respondent as per ANNEXURE-A.
b) Grant such other relief as this Hon'ble Court deems fit to grant under the circumstance of the case in the interest of justice and equity."
4. The petitioner is a Group 'C' employee and working as Senior Health Inspector in the Department of Medical Health. He was temporarily posted on the post of Chief Officer, Grade -II on 13.05.2026. Admittedly, he is not in the Cadre of Grade-II Officer, he is a Grade III

employee. He does not have any right to hold the post of Grade-II Officer. As soon as the Officer of the Grade-II was available, he was posted to the post of Chief Officer, Grade-II on 30.05.2026 and the petitioner was posted to other place on the post of his Cadre.
5. The learned Single judge has considered all the aspects and grounds. We find no error in the order passed by the learned Single Judge. We, therefore, dismiss this appeal as having no merits.
