SM Court No.42
WPA 10386 of 2021
Smt. Reba Bandyopadhyay Vs. The Durgapur Projects Limited & Ors.
Mr. Sujit Sankar Koley … … for the respondents
1. None appears to represent the petitioner, despite having due notice and information regarding the pending hearing of this matter. Learned Counsel for the respondents is present and submits that, in compliance with the previous
order of this Court he has formally communicated with the Learned Counsel, who represented the writ petitioner on the last occasion.
2. Learned Counsel for the respondents submits that the writ petitioner’s entire claim has been fully satisfied by the respondent authorities. Specifically, it is submitted that all outstanding amounts under the heads of gratuity and other retiral benefits, which formed the subject matter of the pending claims, have been completely disbursed. Consequently, the respondents submit that no further amounts remain due or payable to the petitioner.
2
3. In view of the categorical submission made by the Learned Counsel for the respondents and undisputed evidence of full satisfaction of the petitioner’s claim, nothing further survives for adjudication in this writ petition. The petition has consequently been rendered infructuous and warrants dismissal.
4. Accordingly, WPA 10386 of 2021 stands dismissed as infructuous.
5. Interim order, if any, stands disposed of.
6. All parties shall act on the server copy of this
order duly downloaded from the official website of this Court.
