Biswas, Adv. … for the plaintiff The Court: On the prayer of Mr. Joyak Kumar Gupta, learned advocate appearing for the plaintiff, since the plaint has been suffering from some formal defects, according to him, he prays for withdrawal of the suit and to file afresh on the self-same cause of action and between the self-same parties. He submits that the entire requisite Court Fees has been paid. In view of the above, the instant Civil Suit being CS-COM/95/2026 stands dismissed, as withdrawn. The Court Fees paid shall be returned to the plaintiff with a leave to utilize the same if the next suit is filed pursuant to the liberty of this Court. Plaintiff shall be at liberty to file the suit afresh on the self-same cause of action and between the self-same parties but positively within four weeks from date.
