CORAM:
HON'BLE MR. JUSTICE SANJAY VASHISTH. Present: Mr. G.S. Verma, Advocate, for the petitioner. Ms. Ruchi Sekhri, Addl. AG, Haryana.

, J (ORAL)
1. Present 2nd petition has been filed by the petitioner, seeking grant of regular bail, in case, FIR No.352, dated 10.12.2023, under Sections 420, 406 and 120-B of IPC (sections 467, 468, 471 of IPC and offence under section 24 of Emigration Act, 1983 added later on), registered at Police Station Sadar Ratia, District Fatehabad.
2. After hearing the submissions addressed by counsel for the petitioner, on 08.05.2026, following order was passed:-
“1. xxxx xxxx xxxx xxxx
2.
Learned counsel for the petitioner contends that when the first bail petition, i.e., CRM-M-6941-2025, titled as “Navreet Singh @ Navneet Singh v. State of Haryana”, came up for hearing before this Court, petitioner was confined inside jail in another case, i.e., FIR No.272 dated 26.09.2023, under Sections 406, 420 and 120-B IPC, registered at Police Station Sadar Rattia, District Fatehabad. It is submitted that on account of his confinement in the aforesaid case, petitioner could not arrange and repay the amount of Rs.19.00 lakhs involved in the present case to the complainant/victim. CRM-M-4742-2026 -2- Consequently, vide order dated 10.12.2025 (Annexure P-9), said bail petition was dismissed as withdrawn with liberty to file a fresh petition after his release on bail in the aforesaid case.
3.
Learned counsel for the petitioner further submits that petitioner has now been granted bail in FIR No.272 dated 26.09.2023 (supra). Therefore, in
order to enable him to repay the amount of Rs.19.00 lakhs allegedly received from the complainant/victim, the petitioner seeks concession of interim bail in the present case.
4. Considering the aforesaid contention and in
order to examine the bona fides of the petitioner, this Court deems it appropriate to grant concession of interim bail to him. Accordingly, petitioner is ordered to be released on interim bail in this case up-till 03.07.2026, subject to his furnishing bail/surety bonds to the satisfaction of the learned Chief Judicial Magistrate/Illaqa Magistrate/Duty Magistrate concerned, if not required in any other case.
5. List again on 03.07.2026.
6. Meanwhile, registry is directed to issue notice to the complainant as well. To be shown in the urgent list.”
3. Thereupon, on 03.07.2026, following order was passed:-
“Since the petitioner has failed to pay any amount following his release on interim bail pursuant to the order dated 08.05.2026, the said interim bail is hereby cancelled. The petitioner is directed to surrender back to the jail authorities by 5.00 p.m. within one week from today i.e. uptill 10.07.2026. However, aforementioned direction to surrender shall be waived, if petitioner submits a demand draft of Rs. 5 lacs to the complainant before the next date of hearing. In such an event, petitioner shall not surrender back to the jail. List again on 21.07.2026.”
4. Today, learned State counsel submits that present petition is liable to be dismissed on the ground that, despite passing of the order dated 03.07.2026, petitioner neither surrendered before the jail authorities nor paid the sum of Rs.5,00,000/- to the complainant. LAVISHA 2026.07.21 17:24 I attest to the accuracy and integrity of this document PHHC, Chandigarh
CRM-M-4742-2026 -3-
5. At this stage, learned counsel for the petitioner submits that he was carrying a demand draft of Rs.3,00,000/- and is willing to hand it over to the complainant.
6. This Court has considered the submissions advanced by
learned counsel for the parties and has also perused the record available on file.
7. At present, petitioner is outside the jail in violation of the
order dated 03.07.2026 passed by this Court. In these circumstances, request to permit the petitioner to hand over the demand draft of Rs.3,00,000/- to the complainant, cannot be accepted. Furthermore, petitioner is also involved in five other cases of similar nature.
8. Accordingly, present petition is dismissed. However, petitioner is directed to surrender before the competent jail authorities.
