Learned counsel for the applicant would submit that the dispute between the parties arises out of matrimonial discord. It is further submitted that on the previous date of hearing, the parties had amicably resolved their disputes and agreed to withdraw all cases/suits instituted against each other and to initiate proceedings by filing a joint petition for dissolution of marriage by mutual consent under Section 27 of the Uniform Civil Code, Uttarakhand.

Learned counsel for the parties would submit that, in pursuance of the aforesaid settlement, the applicant and the respondent have already filed the first motion petition under Section 27 of the Uniform Civil Code, Uttarakhand on 10.04.2026 before the Court of the learned Principal Judge, Family Court, Dehradun. It is submitted that the parties have undertaken, in terms of the settlement, to withdraw all cases/suits pending against each other before the Courts in the State of Uttarakhand as well as at Ghaziabad. It is further undertaken that prior to moving the second motion petition under Section
2026:UHC:2729 27 of the Uniform Civil Code, Uttarakhand, no proceedings shall remain pending between the parties before any court, including the Family Court.

Learned counsel for the parties further submit that the parties intend to move an appropriate application before the court concerned seeking waiver of the statutory cooling-off period of six months, as contemplated under Section 27 of the Uniform Civil Code, Uttarakhand.

Considering that the parties have voluntarily and without any coercion entered into a lawful settlement, and have already initiated proceedings for dissolution of marriage by mutual consent by filing the first motion petition, it is observed that they shall be at liberty to move an appropriate application before the learned Principal Judge, Family Court, Dehradun for waiver/relaxation of the statutory cooling-off period, which shall be considered by the said court in accordance with law and in the light of settled legal principles governing such waiver.
7. In view of the aforesaid submissions and the settlement arrived at between the parties, nothing further survives for
consideration in the present application.
8. Accordingly, the C-447 application stands disposed of.
9. Pending applications, if any, also stand disposed of.
