Opposite Party --------- CORAM: HON’BLE MR. JUSTICE PRADEEP KUMAR SRIVASTAVA ---------- For the Petitioner : Mr. Rajesh Kumar Singh, Advocate For the State : Mr. Bishambhar Shastri, A.P.P. ----------- 03/Dated: 02.04.2026 1. Heard learned counsel for the parties. 2. The petitioner has been made accused in connection with Raidih P.S. Case No. 45 of 2024 registered under Section 103 (1) of B.N.S., 2023. 3. Learned counsel for the petitioner has submitted that earlier bail application of the petitioner has been rejected by Co-ordinate Bench of this Court in B.A. No. 2782 of 2025 dated 08.04.2025. It is further submitted that in the trial three witnesses have been examined who have not supported the prosecution case as alleged in the FIR. It is further submitted that upon dispute with his mother regarding the supply of food to the petitioner, the petitioner became angry and gave one spade on her head, succumbing to injury. It is next submitted that there is no intentional murder committed by the petitioner. Petitioner undertakes to co-operate with the trial of the case and remain physically present on each and every date till the conclusion of the trial and shall not indulge in tampering with the prosecution evidence or influence the witnesses or gain over them. 4. On the other hand, learned Addl. P.P. has opposed the prayer for bail of the petitioner and submitted that almost five witnesses including the informant are yet to be examined in this case. He further submits that there is serious allegation of killing of own mother by the petitioner. Hence, the petitioner may not be enlarged on bail. 5. Considering the seriousness of the allegation against the petitioner and direct involvement of the petitioner, I am not inclined to grant bail to the petitioner. Hence, the prayer for bail of the petitioner again is rejected. (Pradeep Kumar Srivastava, J.) 02/04/2026 Pramanik/-
