Accused in Crime No.210/2026 registered by Bagalagunte Police Station, Bengaluru City, for the offences punishable under Sections 316(2), 318(4) of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeing anticipatory bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.210/2026 was registered by Bagalagunte Police Station, Bengaluru City, for the aforesaid offences against the petitioner herein based on the first information dated 02.06.2026 received from K.M.Gopalappa S/o late Munishamappa. Apprehending arrest in the said case, petitioner had filed Crl. Misc. No.5978/2026 before the jurisdictional Sessions Court, which was rejected on 24.06.2026. Therefore, he is before this Court. 4. In the typed first information dated 02.06.2026, it is stated that petitioner is acquainted to the first informant and in the month of November 2025, he had assured of providing a - 3 - HC-KAR CNR: KAHC010434952026 NC: 2026:KHC:39961 CRL.P No. 9249 of 2026 seat in a Medical College to the granddaughter of the first informant and had taken a signed blank cheque from the first informant stating that he would be making the payment for the seat in the medical college, and thereafter, would present the cheque for said amount. In the first information, it is further alleged that petitioner had not provided the medical seat to the granddaughter of the first informant, and on the other hand, he had filled up the cheque for a sum of Rs.39 lakhs and had presented the same for encashment, and accordingly, an amount of Rs.39 lakhs was transferred from the bank account of the first informant to the bank account of the petitioner. It is under these circumstances, first informant had approached the police. 5. Learned Counsel for the petitioner has produced certain material before this Court which would prima facie go to show that the granddaughter of the first informant has got a seat in a medical college at Tumakuru. He has also produced the screen shot of certain messages exchanged by the petitioner and the first informant in whatsapp, which would prima facie go to show - 4 - HC-KAR CNR: KAHC010434952026 NC: 2026:KHC:39961 CRL.P No. 9249 of 2026 that petitioner was continuously making a request to pay him the money which the first informant was due. 6. It appears that after the FIR was registered in the present case, the money which was transferred to the bank account of the petitioner was re-transferred to the bank account of the first informant and the petitioner had, therefore, raised objection in writing before the Manager of the Bank. 7. Petitioner, aged 55 years, is a person without any criminal antecedents and he has undertaken to co-operate with the police for the purpose of investigation. Considering the aforesaid aspects of the matter, I am of the opinion that petitioner's prayer for grant of anticipatory bail is required to be answered affirmatively. Accordingly, the following order: 8. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.210/2026 registered by Bagalagunte Police Station, Bengaluru City, for the offences punishable under Sections 316(2), 318(4) of BNS, 2023, subject to the following conditions: - 5 - HC-KAR CNR: KAHC010434952026 NC: 2026:KHC:39961 CRL.P No. 9249 of 2026 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon. 4.
