Ms. Debdooti Dutta ….for the alleged contemnor/NBSTC. This contempt application arises out of an order dated 8th July, 2024 passed in WPA 8079 of 2024. The alleged contemnor was directed to pass a reasoned order with regard to the claim of compassionate appointment made by the petitioner. The reasoned order was required to be passed within three weeks from the date of the said order dated 8th July, 2024. After the contempt application was filed on 15th January, 2026, pursuant to issuance of contempt notice, the alleged contemnor has passed a reasoned order only on 4th June, 2026, that is, after a period of about two years from the date of the order dated 8th July, 2024. The conduct of the alleged contemnor is not appreciated, particularly keeping in mind that the issue 2 of compassionate appointment has to be decided in a time bound manner due to the mandate of the Hon’ble Supreme Court. The alleged contemnor, therefor, who is a very senior officer of the State, is cautioned that henceforth he should not take orders of Court in a casual or light manner to comply with the same as per his whims instead of doing so in a time bound manner as directed by the order. A reasoned order at the end has been passed. This Court cannot go into the merits of the reasoned order in exercise of its jurisdiction under contempt of Court. The contempt proceeding is, therefor, dropped and the contempt application is disposed of. Needless to mention that the petitioner will be at liberty to challenge the reasoned order dated 4th June, 2026, if so advised in accordance with law. (Arindam Mukherjee, J.)
