1. By the present writ petition, the petitioner seeks direction upon the respondent authorities to grant intra-district transfer to a school nearby her present place of residence upon
consideration of the application submitted through Utsashree portal on self-medical ground.
2. The petitioner contends that initially she joined as an Assistant Teacher in Aditya Nagar Primary School under Dhulian Circle, District-Murshidabad on 1st August, 2005. The petitioner’s service has been confirmed with effect from 1st August,
2007. Subsequently, the petitioner was transferred to Kulberia Adivasi Primary School situated at Daulatabad under Sadar North Circle, District- Murshidabad where she joined on 10th April, 2014. The
2 petitioner is suffering from rheumatoid arthritis, Type- II Diabetes Mellitus and hepatic fibrosis. On 2nd May, 2022, the petitioner submitted an application through Utsashree portal before the authority concerned for her transfer on self-medical ground. However, the same is still pending consideration. Hence, this writ petition.
3. Mr. Sakti Pada Jana, learned Advocate appearing on behalf of the petitioner submits that the matter may be relegated to the appropriate authority for consideration of the application of the petitioner seeking transfer on self-medical ground, in accordance with law.
4. Learned Advocate for the District Primary School Council, Murshidabad as well as learned Advocate for the State-respondents concedes to the submission as advanced on behalf of the petitioner.
5. In view of the above, respondent No.3, Chairman, District Primary School Council, Murshidabad is
directed to consider the application of the petitioner dated 2nd May, 2022 submitted through Utsashree portal and dispose of the same, upon giving notice to the petitioner, by passing a reasoned order in accordance with law, within a period of eight weeks from the date of communication of this order.
6. The reasoned order is to be communicated to the petitioner within one week from the date of passing of such order.

7. The respondent No.3 is granted liberty to seek for medical examination of the petitioner prior to
consideration of representation of the petitioner.
8. Learned advocate for the petitioner is directed to communicate this order to the respondent No.3, Chairman, District Primary School Council, Murshidabad.
9. With the above direction, the writ petition being WPA 2359 of 2026 stands disposed of.
10. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted.
11. Interim order, if any, stands vacated.
12. All connected applications, if any, stand disposed of.
13. There shall be no order as to costs.
14. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.
15. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
